O-Chem App Terms of Service

These Terms of Service ("Terms") govern your use of the O-Chem App application (the "Service") operated by O-Chem Shop ("we", "us"). By installing, accessing, or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

You must be at least 13 years old (or older if your local jurisdiction requires) to use the Service. By accepting these Terms you confirm that you meet this requirement.

2. License to Use the App

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Service on devices you own or control, solely for your personal, non-commercial educational use.

3. Subscriptions

Paid features are offered through auto-renewing subscriptions managed by RevenueCat and the Apple App Store / Google Play Store. By purchasing a subscription you agree to the store's terms of sale.

• Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period.
• You can manage or cancel subscriptions in your store account settings.
• Refunds are handled by the relevant app store.
• Free trials convert to paid subscriptions unless cancelled before the trial ends.

4. User Content

You retain ownership of any content you submit to the Service (prompts, drawings, molecule images, notes — "User Content"). You grant us a worldwide, non-exclusive, royalty-free license to host, store, transmit, and process User Content solely to operate and improve the Service, including sending it to our AI subprocessors (OpenAI, Google Gemini) to generate responses.

You are responsible for your User Content. Do not submit content that is unlawful, infringing, or that contains personal data of others without their consent.

5. Prohibited Uses

You agree not to:

• Reverse engineer, decompile, or attempt to extract the source code of the Service (except as permitted by applicable law).
• Use the Service to cheat on assessments or violate your school's academic-integrity policies.
• Submit content that is illegal, harmful, or infringes the rights of others.
• Interfere with the Service, its security features, or other users.
• Use the Service for any commercial purpose without our written consent.

6. Educational Use Only

The Service is provided for educational support. It is not a substitute for instruction, laboratory work, professional advice, or your own academic effort. Do not rely on AI-generated content as a definitive source. We do not guarantee any particular grade, learning outcome, or exam result.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, O-CHEM APP WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (US$100).

9. Indemnification

You agree to indemnify and hold us harmless from any claim arising out of your violation of these Terms or your use of the Service.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to other users or the Service. You may stop using the Service at any time.

11. Governing Law

These Terms are governed by the laws of the State of Wisconsin, USA, without regard to its conflict-of-laws principles. Any dispute will be resolved exclusively in the courts of that jurisdiction.
